Terms of Service

These Terms govern your use of ToolMate AI. By creating an account or using the service, you agree to them. Please read the safety disclaimer in section 6 carefully.

1. The Service

ToolMate AI (ABN: 12 456 352 027) ("we", "us", "Provider") provides a self-serve, subscription software platform for Australian trades and construction businesses, made up of:

  • QuoteMate — AI-assisted generation of professional quotes from a scope of works, a Quote Check second-opinion review, and variation claim drafting.
  • SafetyMate — AI-assisted generation of WHS document drafts including Safe Work Method Statements (SWMS), Job Safety Analyses (JSA), Risk Assessments and Toolbox Talks.

All outputs are drafts prepared by you, using AI assistance. You are responsible for reviewing, completing and verifying every document before you rely on or issue it (see section 6).

2. Accounts & eligibility

  • You must provide accurate account information and keep your login secure. You are responsible for activity under your account.
  • The service is intended for business use by trades and construction operators in Australia.

3. Plans, fees & billing

  • Current plans and prices are shown on our pricing page and confirmed at checkout. Plans are billed monthly or annually in advance, in Australian dollars, via Stripe. Applicable GST is shown at checkout.
  • Subscriptions renew automatically each billing period until cancelled. By subscribing you authorise recurring charges to your payment method.
  • Free trial: new accounts may start a 14-day free trial with no card required. If you do not add a payment method, the subscription will not begin charging when the trial ends.
  • We may change prices for future billing periods with reasonable notice. Price changes do not apply to a locked "Founder" plan for as long as that plan remains active.
  • Usage limits (such as document quotas on the Starter plan) are described on the pricing page and enforced in-app.

4. Cancellation & refunds

  • You can cancel at any time, yourself, from the Billing area of your account — no notice period and no phone call required.
  • When you cancel, your plan stays active until the end of the period you've already paid for, then access ends. We do not charge again after cancellation.
  • Except where required by the Australian Consumer Law, fees already paid are non-refundable and we do not pro-rate partial periods. Cancel before your next renewal to avoid the next charge.

5. Your data & privacy

  • Documents and account data you create are stored in our secure, access-controlled database to provide the service to you.
  • Text you submit is processed using Anthropic's Claude API to generate outputs. Anthropic does not train its models on API inputs.
  • The Quote Check tool does not store the quote text you paste or upload — only the resulting review is saved.
  • We do not sell, rent or share your data with third parties except service providers needed to run the platform (e.g. hosting, payments) or where required by law.
  • You can delete your documents in-app and request account deletion by emailing us. See our Privacy Policy for full details.

6. Safety disclaimer & limitations (important)

  • SafetyMate outputs are AI-assisted drafts, not certified or compliant documents, and not legal or work health and safety advice. A draft must be reviewed, completed and approved by a competent person, and adapted to the actual site, task and conditions, before it is used. You remain responsible for meeting your WHS obligations.
  • QuoteMate outputs (quotes, reviews, variations) are estimates and drafts based on the information you provide. You are responsible for checking all pricing, scope and figures before sending anything to a client.
  • References to legislation, standards or regulators in generated documents indicate the framework a draft was prepared against — they are not a representation that a document is compliant or approved.
  • To the maximum extent permitted by law, we are not liable for any loss, damage, injury, penalty or cost arising from the use of, or reliance on, any generated document. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
  • The service is provided "as is". We aim for high availability but do not guarantee uninterrupted service, and are not responsible for outages caused by third parties (e.g. hosting, Google, Anthropic, Stripe).

7. Acceptable use

  • Don't misuse the service: no unlawful use, no reselling or sharing your account beyond your plan's user allowance, no attempts to disrupt, reverse engineer or overload the platform, and no automated abuse of generation limits.
  • We may suspend or terminate accounts that breach these Terms or put the platform at risk.

8. Intellectual property

  • You own the documents you generate (quotes, SWMS, etc.).
  • We retain ownership of the platform, software, and the prompts and workflows used to deliver it.

9. Support

Support is available by email at hello@mytoolmate.com.au. We aim to respond within 1–2 business days.

10. Changes & governing law

  • We may update these Terms from time to time; material changes will be notified by email or in-app, and continued use means acceptance.
  • These Terms are governed by the laws of New South Wales, Australia.
